There is a lot to consider when divorcing. By a divorce, I also mean that you separate if there is a cohabitation contract, a registered partnership or if you have minor children together. In all those situations, all kinds of legal, financial and tax matters can be arranged. If you have children, they are central.

 

Separation notice

 

The divorce notice is the moment when one of the partners tells the other that they want to end the relationship. The sooner you go to a mediator after the divorce notification, the better. I always first pay attention to the divorce notification. Are you sure of that and do you both support it?

 

The children and your divorce

 

A mediator is neutral and impartial, except when it comes to the children. Their importance comes first! I can give you information on the correct way to conduct the 'umbrella conversation'. This is the conversation in which you tell the children that you are separating. Specific aspects are important for each age group.

 

Parenting plan

 

If you have minor children, a parenting plan is almost always mandatory.

What should in any case be:
- The division of the care and upbringing of the children;
- The costs of the care and education of the children (child support);
- How you inform each other about the children.

 

Alimony

 

Married or registered parents have a duty to care for each other and for their children, even after they are divorced. First of all, child support is calculated. Then it is examined whether there is an obligation and scope for partner maintenance. Of course I will help you determine that and make the necessary calculations. If you are not married and are not registered partners but have minor children, then the law also sets requirements for the care and handling of your children and the payment of child support.

 

 

Covenant and settlement agreement

 

When you separate, it will be determined, depending on your situation, how the division of your belongings and debts should take place. Were you married in community of property? Do you have your own home and maybe your own company? What about inheritances and accrued partner's pension? There are many more questions that arise. Whether you have children or not, expert help is of course highly desirable. I ensure that everything is legally justified and recorded in writing in an agreement in understandable language. This is also referred to as a covenant and settlement agreement.
